The Brain that Wouldn't Die Fiasco

 * UPDATE - Since the time of this posting SHOUT! Factory has reviewed and released their claim. See the full update here.

I've been posting episodes of my CREATURE FEATURE TV series on YouTube lately, and last week decided to post the THE BRAIN THAT WOULDN'T DIE episode. That one originally aired April 8, 2006 on Nashville's CW58 - almost 10 years ago to the day I type this. It was one we spent a little more time on than usual with set design, lighting, and skits. It turned out really well, and I looked forward to sharing it.

However, within fifteen minutes of posting this video on YouTube I received eight copyright claims against it. This will sound familiar to anyone who has dealt with YouTube lately. It is common practice for people to try and claim copyright on well-known public domain films such as THE BRAIN THAT WOULDN'T DIE. They are bogus claims and are usually dropped once a dispute is placed. That wasn't the case this time, however.

For those not familiar with the process, the way it works is you post a video and if there are copyright claims against the video you receive email notification from YouTube informing you who is making the claim and against what element of your video (video, music, etc). From that point on the claimant is granted immediate rights to your video, meaning they can monetize it and make money off your video, block it in certain parts of the world, or even force it down immediately and give you a copyright strike.

Your only option at that point, if you feel the claim is unjustified, is to file a dispute. I did this, as seven of the claims were against music and clearly bogus claims from non-existent companies. One of the claims, however, was for the video itself, and came from SHOUT! FACTORY.

Now Shout! Factory is a well known video distribution company. They make great products, and I love their work. Their claim to own THE BRAIN THAT WOULDN'T DIE, however, is complete and utter horseshit.

______________________________________________________________________________

THE BRAIN THAT WOULDN'T DIE is a 1962 b-horror film directed by Joseph Green, written and produced by Rex Carlton. it's a wonderfully trashy mad-science flick about a doctor who keeps his wife's severed head alive in a tray while searching for a replacement body in the local strip clubs.

It is also clearly in the public domain.

On September 29th, 1988 Rex Carlton Productions filed for copyright renewal of this film - the case # is PA#399511. They cited 1959 as the year of production and October 31, 1962 as date of publication.  Their copyright was NOT renewed, meaning the film was now in the public domain.

Skip forward to August 26th, 1993. A company named BEST BRAINS INC. filed for copyright of this film, case # PA668-012. it was for Mystery Science Theater 3000 #513, THE BRAIN THAT WOULDN'T DIE. Copyright was granted, but it extended ONLY TO NEW MATERIAL - i.e. host bits of MST and their running commentary.

This is important to remember because MST is now distributed by, you guessed it, SHOUT! FACTORY, the company that is claiming on YouTube to own the entire film THE BRAIN THAT WOULDN'T DIE. They do not. I disputed this and within 24 hours was told that Shout! Factory reviewed my claim and decided they still own it. End of story.

Now my only recourse at this point is to file a formal appeal, but, here's the thing. It goes straight back to the claimant - Shout! Factory in this case - who simply says yes or no to owning it once again. There is no review process by YouTube, the claimant does not have to show proof of ownership, nothing. YouTube simply takes them on their word and upholds their case. I would at this point receive a copyright strike against my channel, meaning I lose rights to monetize any of the videos on my channel for 6 months. Any channel that receives three strikes is permanently removed!

So at this point there is nothing to do. I could just leave the video up and let Shout! Factory make money off my video, but it is the principal of the matter. they don't own this film. IT IS IN THE PUBLIC DOMAIN. They know fully well they don't own it. I did not use any elements from the Mystery Science Theater version of this film. I've never even seen the MST episode. Anyone who knows me knows I'm not a fan of their show, never have been. I respect what they've accomplished, but I'm not a fan. My material is 100% my own. The movie footage I used was from a copyright free copy of the movie.

ALPHA VIDEO version
of The Brain that Wouldn't Die

SO, SHOUT! FACTORY, if you see this post, please respond. You can reach me through email drgangrene at hotmail.com. If you really think you own this film, then I would love to know on what basis...

You distributed the impressive 2015 blu-ray edition of the film, and certainly own that cleaned-up edition - and you distribute the 1993 MST version, and clearly own that as well. But neither of those make you copyright owner of this movie. It is 100% in the public domain. The Rex Carlton Production company - who shot the film - couldn't renew copyright on it, and neither can you.

I am going to find another place to post this entire episode for folks to enjoy. In the meantime, I'll post just my host bits on YouTube, unless Shout! Factory decides to block that too.

Here is a link to the film on archive.org for those wishing to see the movie in its entirety:

Note it's filed under PUBLIC DOMAIN.

Sir Cecil Creape - 1970s Nashville Horror Host

Sir Cecil Creape
a.k.a. The Phantom of the Opry

Before starting his own venture into horror hosting Dr. Gangrene joined Sir Cecil's Ghoul Patrol, in 1974 in the Boy Scouts. It was part of his uniform then, and it is part of his uniform once again, on the mad doctor's lab coat!!

"Did Someone Call?"
Nashville's best known horror host,
Sir Cecil Creape, terrorized the
Nashville airwaves throughout the
early 70's and 80's.

CREATURE FEATURE
SIR CECIL CREAPE, aka THE PHANTOM OF THE OPRY was played by Russ McCown, and was perhaps Nashville's best known horror host. His show originated on WSMV, channel 4 Nashville, and was called Creature Feature. It aired on Saturday evenings, at 10:30pm and ran from 1971-1973. During that time Sir Cecil hosted a bevy of movies and always had lots of skits in between breaks. The set was a dungeon, with stone walls and fireplace which always had a picture of Floyd Kephart, local political analyst, on it.

In the 1980s Russ revived the character of Sir Cecil on a national stage on TNN, The Nashville Network, on cable TV. TNN would eventually become SpikeTV.

Recurring Characters on Chiller Cinema/Creature Feature

At the Paranormal Fest in Murfreesboro TN a few months back I met Blake Powell, the director of the horror host program Midnite Mausoleum (starring Marlena Midnight - see post here) He is a really cool guy, and I enjoyed hanging out with him. Over lunch we talked and compared notes on our shows, and during the course of our conversation he asked me about Oogsley, the hunchbacked lab assistant on my original show, Chiller Cinema. In particular he was curious about the original Oogsley, the one in the first batch of shows.

The topic also came recently in a podcast interview I did with a guy named James Downing (Monsters from the basement – see article). There have been quite a few recurring characters through the years, so I thought I’d take a minute and recognize the ones that have popped up on both shows, Chiller Cinema and Creature Feature, over the years…

______________________________________________

Oogsley #1 – The first recurring character on Chiller Cinema was Oogsley, the hunchback lab assistant. The original Oogsley bore a striking resemblance to the Doc Gangrene physique-wise, leading many viewers to (correctly) guess that perhaps both characters were played by the same actor.  I originally thought it would be funny to have both played by the same person, with the audience in on the joke - and it was for a while, but eventually I thought it would be better to have an Oogsley that I could interact with.

Major Monterey Jack - Monster hunter and bumbling idiot, Major Monterey each week took viewers on a (mostly) unsuccessful hunt for a different monster on Shackle Island. Major Monterey was also played by me.

Barnaby Bones – Barnaby Bones was a wisecracking skull in a cage that resided in the Gangrene laboratories. He was a constant source of irritation with his sarcasm and never ending stream of bad jokes.

Madam Fortune – Mystic and fortune teller Madame Fortune made several appearances on Chiller Cinema in the early days. She was usually consulted when an unexplained paranormal event occurred or when someone needed their fortune told. Madame Fortune was played by my wife, Karlee.

Oogsley # 2 – The second Oogsley came on the scene at the end of season one. Dimwitted and clumsy, he never ceased to frustrate Doc Gangrene. Oogsley eventually disappeared one day while hunting for crickets in the catacombs and never returned. Oogsley #2 was played by Brandon Lunday.

Icky the Putrid Postman – Icky was the ill tempered mail clerk on Shackle Island. One day he lost a mail delivery to a gypsy and gave her the cold shoulder about it – afterwards she cursed him to forever deliver mail to the dead. Icky bears an uncanny resemblance to Oogsley 2…Icky was also played by Brandon Lunday.

Nurse Deadbody – The sexy Nurse Deadbody came onto the scene for a season on Shackle Island and brought a bit of sanity, along with heaps of sarcasm, to the lab. She was played by my wife, Karlee. She eventually left to take a better job at a medical facility on the other side of the island.

Nurse Moan-eek – In season 5 the bubbly Nurse Moan-eek took a position in the Gangrene Laboratories. The Doc’s late Uncle Mortimer lost his entire fortune in the great pumpkin famine, and all he had left to will to his nephew was his faithful Nurse, Moan-eek. Gangrene always suspected Mortimer secretly hated him, as Moan-eek’s help was often less than helpful. Moan-eek was played by Linda Wylie.

Otto Von Lump – Ordered from a Mad Scientists magazine, Lump took employment on Shackle Island for a season. He was a dimwitted assistant (is there any other kind?) with a hunch back and large scar down his face. Otto was played by Paul Browning.

Gibson the Undead Rocker – This rocker’s tour bus crashed just outside the Gangrene estate and Gibson found himself not dead yet not quite alive. He took up residence in Gangrene Manor and he would jam with Gangrene, often working up songs based around that evening’s movie. Gibson was played by John Hudson.

This week's Creature Feature

This week's creature Feature is a movie that'll really bug you - it's a story about a high rise building with a major ant infestation. These ants aren't just any old ants though - they're radioactive killer ants!

It's called GLASS TRAP and believe me, it ain't no Empire of the Ants - schlocky fun Fred Olen Ray style. It stars C. Thomas Howell, the Soul man himself, and a horde of enlarged and enraged ants.

I tell ya, something about this movie just crawls all over me...

Dr. Gangrene's Anniversary

Today is the anniversary of the very first broadcast of my TV show, on July 1, 1999. My how time flies. Since then I have changed format, rotated cast and crew members, and moved the show to regular broadcast TV. We're now a 2 hr program - it was just a half-hour one when we started. The show is now called Creature Feature - the half-hour program was called Chiller Cinema. It ha been a fun ride and the next phase of it begins in a couple of weeks when we go back to a weekly broadcast. Thanks to everyone who has watched and supported and helped make this program a success.

Here is the original open for my show and a brief part of the pilot episode. I didn't have any theme music when I began, so I went to a neighbor's house and played a moody tune on his keyboard. Worked well for a while... the house is an old abandone house in Hendersonville. It is no longer standing - it finally collapsed in a storm. I always thought it was cool and eerie looking, so when we began the show I called the realtor for the property it was on (which was for sale) and asked if I could use it for the show. He said fine... we had to scale a fence to get to the house. The close-up portion of this is actually my Grandmother's basement. I always  used to get creeped out down there and loved it! I remember going down there with the lights off and seeing how far i could walk into it before I got freaked and ran out. Then I'd go back and try again when my courage got up!!

Funny stuff there. You'll notice the scars on my face. Yeah, that lasted for a while until I got tired of using spirit gum all the damn time. I wrote them out in a later episode. When I call for Oogsley in this bit, my assistant, that is me doing his voice. I didn't have any editing facilities at the time, and was doing all my cuts with two VCRs. Any effects I used were real time - so my director and camera guy, Chuck Angell, just hit play on a tape recorder to play a pre-recorded bit.

Man, seems a hundred years ago. Funny to go back and look at the early stuff. Let me know if you guys want to see more of this. I have every episode saved, on either VHS-C, SVHS, Mini-DV or DVD. I can post some segments from time to time if there is demand for it.

Back in town with a big announcement!

Hey guys - I've been on vacation for the past week and didn't have computer access, therefore no new posts here. I am back in town now and getting settled in a bit. Got some new news to share - my show, dr. Gangrene's Creature Feature, will be back on the ariwaves regularly starting the second sat in July!

You'll be able to find it on the CW58 in the Nashville area every sat afternoon from 1-3pm. So if you're in the area, check it out! The first film is Deep Shock, from 2003. A really bad movie that was made for sci-fi. should make perfect sat afternoon monster movie fare!

Happy birthday to Classic Horror Icons - Cushing, Lee & Price!

The two day span of May 26-May 27th were an influential one for classic horror fans. May 26th marks the birthday of Peter Cushing, and May 27th is the birthday of both Vincent Price and Christopher Lee!! It's amazing to think all three of these performers were born within that two day span, albeit several years apart (Cushing 1913, Price 1911, and Lee 1922).

I had the pleasure of showing THE HOUSE THAT DRIPPED BLOOD not once but twice on my show, Creature Feature. It features both Cushing and Lee - and best of all, I was able to air it on May 27th, so it actually was on the air during Lee's birthday. very cool!

What would have been even cooler is if I could have shown House of Long Shadows or Scream and Scream Again, both films that have all three of these actors in them. I will keep my claws crossed that either of these show up on the station's movie list next quarter.

Here is the trailer for The House that Dripped Blood. It is a GREAT Amicus anthology featuring four short stories and a wrap around segment. Easily my favorite movie I've hosted on Creature Feature.

Next Creature Feature...

Okay, I told you guys the wrong movie for next Saturday. We'll actually be showing THE HOLLOW, from 2004, starring Kaley Cuoko (Big Bang Theory) and Nick Carter (Back Street Boys). As I said, this is one we shot last October but which never aired due to technical difficulties. Pretty good little movie - kind of a teen headless horseman movie.

Catching Up

Can we talk? Seems like it’s been a while
since I just chatted here about stuff in general…

  • The comments section of my blog was disabled for a few days. I had experimented with another comment program called Disqus – for you bloggers out there, a friendly word of warning. I HATED that program. It took over my comments, was difficult to use, ugly to look at, and a pain to uninstall. When I finally did manage to get it off here it disabled my comments and I had to reinstall my template, which was yet another pain. I lost a few comments that were made from folks in the interim. All in all, not a good experience.

  • So far this year I’ve managed to blog every day. In the past this was a real chore. This time around I’ve managed to not only find time to do this but have really enjoyed writing about whatever crosses my mind, posting pictures, links, reviews and interviews, etc...

  • This weekend is the Lone Wolf Full Moon Tattoo Festival in Nashville. I am going to try and make it out there one day this weekend. Hope to see you there. They have some great guests and you can see the entire list here.

  • I have another Creature Feature airing next week. The movie I’m hosting this time around is THEY CRAWL. It is a pretty awful movie about genetically mutated killer cockroaches. Features some really terrible computer generated roaches which have to be seen to be believed – at one point they al form together into one giant roach – yes! It airs on the Nashville CW58 at 1pm, Saturday, May 1st. This was one of the movies we shot host bits for back in October but due to technical difficulties it never aired. I figured now was as good a time as any, so May 1st it is.

  • Speaking of May 1st, that is the date of the next Spookhand show, too. It takes place at The Muse and features 4 bands: Spookhand, Alucard, Uncle Skunkle, and Dirty Dee and the Sweaty Meat. We’ll be playing a couple of new songs, so should be good - or a disaster, one or the other – but one thing’s for certain, we’ll have fun either way.

  • I missed a movie at the Nashville Film Festival last night that I had fully intended to see. Vampire Girl vs. Frankenstein Girl. A Japanese fright fest featuring exactly what it sounds like, monster femme fatales fighting... Should drive the fan boys wild! Hate to miss a good old fashioned monster flick like that, seeing as they don’t come to the big screen that often. I’m proud of the Nashville Film Fest for including this one. It isn’t often they show horror movies, and certainly not ones as purely exploitative as this.

  • I’ve been feeling a little down and nostalgic lately. My middle son Ian is graduating high school this year. Man it seems like only yesterday he was 8 years old and dressing as Dr. Gangrene for Halloween. That was one of the biggest thrills since doing this show – how many dads get to say their son dressed as them for Halloween? Now he’s 18 and about to head to college in the fall. Sigh. Time really does pass too quickly – but he’ll always be my little buddy.

Well that’s all for now. I have a bunch of other good stuff coming in the near future – more original artwork, more interviews, more reviews and more videos - so stay tuned!!

NOSFERATU

Taking a quick break from the Wolfman posts for a moment, here's a video for a song by one of my favorite bands, the 3D Invisibles. This was put together by my camera man Brian Hickman - good stuff!

Dr Gangrene's Howliday Special promos

Two promos that are running now for the upcoming DR. GANGRENE'S HOWLIDAY SPECIAL - a 15 second and a 30 second promo. In this episode I'm hosting a Christmas Carol, narrated by Vincent Price, and the Three Stooges short "Malice in the Palace." I am also showing a clip of classic Sir Cecil creape's Creature Feature from 1971!! They air Saturday, December 26th at 9pm on Nashville's CW58 - Gonna be a fun one!!

Recommended Movie of the Week #12

The recommended movie of the week #12 was the George Romero classic, Night of the Living Dead, perhaps the greatest horror movie ever made.

Monday, November 2

Creepy Crawlies

This past Saturday wrapped up this season's Creature Feature Halloween lineup. The movie was "They Crawl" and hoo-boy, what a stinker. Genetically mutated killer cockroaches that terrorize a city and eventually all form together into one giant cockroach that chases our heroes... unfortunately it really isn't anywhere near as cool as that sounds.

The CGI reminds me of how good movies are that don't rely on computer effects. In the old days they would have had real live critters - see "Frogs" for a good example of this, or, better yet, "Creepshow" - that one is another roach movie done right. "They Crawl" was made in 2001, so it really has no excuse - special effects and computer generation had come so far by this point that they should have much more realistic bugs than this. The scene from the the picture above, in particular, was probably the worst of the film – this guy is strapped down and the insects released on him to feed. It is just really, really poorly done.

We had fun with it and I think it made for a nice Halloween afternoon Creature Feature. Here’s hoping you all had a terror-ific Halloween. Boo!

New Dr. Gangrene Newspaper Article

The following article ran in a number of newspapers across Middle TN this week, including the Hendersonville Standard, The Gallatin Newspaper, Wilson Post, Williamson Herald, etc.. Just thought I'd post it here for your enjoyment, along with a few pics they took too -
Happy Halloween!!

Eerie things are going on in an old tool shed in a Hendersonville backyard.

By SCARY KEN BECK
Special to Main Street Media

It’s nothing new, because strange things have been brewing in the madcap mind of Nashville TV horror host Dr. Gangrene for 10 years.

Gangrene, who is host of “Chiller Cinema,” at 1 p.m. Saturdays on WNAB-Channel 58, tapes his show in his secret hidden lab, aka Gangrene Manor, in the midst of suburbia, but all normalcy ceases once mortals cross this threshold.

Turn to the right inside the tool shed turned studio and spy Styrofoam bricks painted to appear like a dungeon wall with curious laboratory equipment awaiting the doctor's maniacal touch. To the left looms a creepy Victorian-style mantelpiece with a pair of skulls, a fireplace, tattered old wallpaper and a midget knight in armor. And, if a visitor doesn’t watch his step, well, just beware of a trapdoor somewhere underfoot.

The mischief maker behind this mixture of hilarity and hauntedness is a nearly average guy by the name of Larry Underwood, whose day job for 15 years has been as a graphic designer for the V.A. Medical Center and veterans’ events in Nashville.

But on nights when the moon is full, or when it’s time to tape a show, Underwood transforms into the somewhere-between-the-goofy-and-the-ghastly Dr. Gangrene.

“Dr. Gangrene is mad scientist with a large ego who loves all things monster and Halloween,” says Underwood. “It’s his wish to make it Halloween all year long. He endeavors to do so by showing bad monster movies and cooking up strange experiments in his lab.

“Over the years Dr. Gangrene has become more like me. I’ve worn less makeup and the and costume has sort of changed,” said Underwood, who garbs his psychotic physician in white lab coat and black goggles.

The self-effacing TV show host concocted his character after tiring of writing and drawing comic books with creative partner Chuck Angell.

“I decided it would be neat to do a show of the type we had when I was growing up, a horror TV host that I remember, Cecil Creape and his ‘Creature Feature.’ I had a friend doing a cable access TV show at the time, and he suggested I give it a try,” Underwood recalled. “Chuck thought it would last three weeks, and here 10 years later, I’m still doing it.”

Doc Gangrene and his “Chiller Cinema” debuted July 1999 on the Hendersonville cable access channel and then hopped to the Nashville cable access channel and then to the UPN station before landing at The WB about three years ago.

His inspiration was a blend of two TV characters: Sir Cecil Creape, sort of his monster mentor, who was portrayed by the late Russ McCown, and Anthony Edwards, star of the now deceased NBC sitcom “E.R.”

“When ‘E.R.’ was popular, I was getting stopped by people and told, ‘You look like that guy from ‘E.R.’, Dr. Green (Edwards).’ I thought it would be funny to do a twisted version of medical doctor from Dr. Green to Dr. Gangrene,” said Underwood.

“I waned to do a show liked Sir Cecil Creape, who I met once when I was a Boy Scout. I got a patch that said ‘Sir Cecil’s Ghoul Patrol.’ The first thing I did when I started my show was sew his patch on my lab coat. It was real important to keep the show family friendly like Sir Cecil did.”

(McCown’s “Creature Feature” aired in the early 1970s on WSM-Channel 4 and was resurrected on The Nashville Network or TNN in the early 1980s.)

Nashville native Underwood graduated from Stratford High School before earning a degree in graphic design at Middle Tennessee State University. He and wife Karlee have three sons: Rob, 18, Ian, 17, and Luke, 12.

He has had four sidekicks over the decade as Linda Wylie currently fills the bill as Nurse Moan-eek. Gangrene’s henchmen included Oogsley and Lump, while Karlee used to portray Nurse Deadbody and fortune teller Madame Fortune.
Larry and Karlee celebrate their 15th wedding anniversary on Oct. 29.

“We were gonna get married on Halloween at a bonfire, but my parents found out,” said Karlee. “They wanted us to have a church wedding.

“Larry’s a natural as Dr. Gangrene. I was proud to see how far he’s come with it from cable access TV to regular commercial television on The WB. All of the boys grew up around it. The oldest two are more athletic, but our youngest one loves it.”

Underwood’s “Chiller Cinema” can take as much time as 40 hours to tape and edit an episode. For his efforts, he was nominated for a local Emmy Award and has captured two Rondo Awards (for classic horror excellence) for best Web site and for public service announcements that he has done for the state of Tennessee on littering and a fasten-seatbelts campaign.

He also has met many stars of classic horror films at conventions while taping interviews for his show. Those include director George Romero (“Night of the Living Dead”) and actors Gunnar Hansen (the original “Texas Chainsaw Massacre”), Michael Berryman (“The Hills Have Eyes”), and Ben Chapman and Julie Adams (“The Creature From the Black Lagoon”).

Recently, he has taken his horror hobby one step further as a vocalist with the horror punk Band Spookhand as he warbles about monsters and blood, etc.

“I do Dr. Gangrene for the fun of it. I haven’t really made any money at it but do it just for love of the genre. I have to have a creative outlet of some sort and this is it,” says Hendersonville’s only dad who moonlights as a mad scientist on TV.

This Blog It Is A Changin'...

I have decided that this blog needs to get back to what it was originally intended for... updates about the Creature Feature TV show, Doctor Gangrene himself and all his current happenings and appearances, as well as insights into the roots of the show and it's evil incarnations.

If you have been tuning in to read the current stream of weirdness and fun posts of what I've been up to outside of the show, then I have started a seperate blog where those and other assorted shennaginans will continue...

Dr Gangrene's Creature Feature back on the air

Dr Gangrene's Creature Feature is back on the scarewaves! Here's the update I mailed out to folks today...

Join the mad medico and his lovely assistant Nurse Moan-eek as they present a new fright flick every Saturday afternoon at 1pm during September and October.

The doctor is celebrating his 10th season as Nashville's horror host, and this season has added a new feature to the films - FACT-O-RAMA! So be sure to tune in every week - the first film in the new season is the schlocky grade z-movie THE BRAIN THAT WOULDN'T DIE, which features a living decapitated head, mad scientist, mutated monster in a closet, strippers and more!!

Other movies in the lineup include THE LAST MAN ON EARTH (the first filmed version of I am Legend starring Vincent Price), WHITE ZOMBIE starring Bela Lugosi, Hammer films' THE HOUSE THAT DRIPPED BLOOD starring Peter Cushing and Christopher Lee, and the horror classic NIGHT OF THE LIVING DEAD.
